Terms & Conditions
Please read the following Terms and Conditions before booking your portraiture session:
Booking Deposit & Rates:
1.1: A deposit will be required upon making your booking. Session deposits are $100.
1.2: Session rates are subject to change for future bookings, and you cannot claim a previous session rate if the rates have changed. (This does not apply to bookings that have been paid).
Cancellations:
2: If you cancel your session with more than 7 days notice, your deposit will be refunded to you.
If you cancel with less than 7days before your session, a $30 cancellation fee will apply.
If you cancel less than 3 days (72 hours) before your session you will forfeit your deposit. You may choose to reschedule your session (see point 3).
Rescheduling / Change of session date and time:
3.1: Sessions can be changed with no loss of deposit with more than 72hrs notice before your session time.
3.2: If you change your session with less than 3day (72hrs), you will lose your deposit. You will be invoiced the full amount for a new session.
3.3: In the event that the Client requests to reschedule its session on account of illness, emergency, act of God or any cause outside its control, the retainer will be applied to a rescheduled session provided that notice is given at least 72 hours prior to the scheduled PHOTOSHOOT (or reasonable notice in the case of an emergency).
3.4: The rescheduled session must be within 2 weeks of the original session date (or a longer period as agreed by PHOTOGRAPHER and Client in writing) and is subject to the availability of PHOTOGRAPHER. Any Client that is late arriving to the session will have the remaining amount of time allotted for the session. All additional time beyond the scheduled end time will be billed to the Client .
3.5: If you re-schedule for a 2nd time with 7 days notice there will be a $50 administration fee.
3.6: Requests to reschedule by Clients for any reason other than a reason under clause 3.3 is at the discretion of PHOTOGRAPHER.
3.7: If the PHOTOGRAPHER is unable to perform the services in this contract due to illness, emergency, fire, casualty, strike, unsafe environment, threat, act of God or any cause outside its control: PHOTOGRAPHER will make reasonable efforts to arrange a substitute photographer who is prepared to perform the services under this contract for the price agreed in this contract if the PHOTOGRAPHER is unable to perform services; PHOTOGRAPHER will return in full all payments made by CLIENT to PHOTOGRAPHER in relation to this PHOTOSHOOT if a substitute photographer cannot be found.The substitute photographer is chosen at the discretion of the PHOTOGRAPHER and does not constitute a breach of this agreement. PHOTOGRAPHER warrants the substitute photographer to be of comparable quality and professionalism.
Weather:
4.1: If we plan to shoot outdoors, we may need to reschedule your session due to weather, or change to a studio session with no loss to your deposit.
If you are unable to reschedule, and cannot shoot indoors, your deposit will be refunded to you.
Images and Image Proofs:
5.1: If you have any specific shoot requirements, please discuss with me prior to the shoot. We will review the photos are we go to ensure we capture your requirements.
5.2: Image proofs are for viewing only. These images are not to be used for personal or commercial use. Any use, redistribution, or altering of proofs is considered a copyright breach.
5.3: In the event of no proofing, the PHOTOGRAPHER retains the right of discretion in selecting the photographic materials released to the client.
Retouching:
6.1: Basic retouching is included in the fee. Basic retouching covers adjustments to contrast, colour, cropping, and basic skin cleanup.
6.2: If you desire more advanced retouching, extra fees will apply and the delivery time of your images may need to be extended.
Image Delivery:
7.1: All photographs will be shot in digital format. Digital photos will be made available on a private online gallery available for download. Photos will be delivered as high-resolution JPEG files in an online gallery. RAW files will not be provided.
7.2: For headshot session (1-3 images), your images will be delivered no later than 1 week after the shoot date. For larger packages, your images will be delivered with 4 weeks.During busy times allow extra time. The photographer will notify you prior to your session of the expected amount of time delays.
7.3: The final post production and editing styles, effects, and overall look of the images are left to the discretion of the PHOTOGRAPHER.
Payment:
8: Payment is due in full on or prior to the day of the shoot (or as noted on your invoice). For overdue payments, fees may apply.
Additional images & products (like Prints):
9: Your booking determines the number of final images you will receive â digital or printed. Extra digital images, prints, wall art, and albums can be purchased in addition to your session/package.
9.1: Services or merchandise not included in this initial contract will be sold at the current price when the order is placed. All prices are subject to change at any time without notice. Credit vouchers have no intrinsic cash value and may only be applied toward products or services purchased.
Ownership, Copyright, and Permission for Use (Licensing):
10.1: When booking a photoshoot session you agree that Cindy Brewty of Brisbane Business Portraits is the sole and exclusive owner to all photos, and reserves all rights and copyright of the photos.
10.2: For the final digital files included in your session, you are granted a non-exclusive, perpetual license to use the photos. You agree that under your license you will not use the photos for: unlawful use, on products for resale, and/or sublicensing.
Privacy:
11.1: Brisbane Business Portraits is bound by the Privacy Act 1988 , which sets out a number of principles concerning the privacy of individuals. If you wish to view this in full, please click here.
11.3: Upon booking or after your photoshoot, you have the option to opt in or out of having your images included in our portfolio (website, social media, marketing materials). Your decision will be respected. And you may change your mind at any time.
Refunds:
12.1: At Brisbane Business Portraits we do everything in our power to ensure your complete satisfaction with the process and final results. To ensure youâre happy with the photos, we review and discuss the shots as we go. If you require any changes to the photos or approach, please discuss it with us during your shoot, and we encourage you to express any concerns so we can address them. We always check that you are happy with the images before you leave, due to this, we cannot guarantee a refund if you later decide you are unhappy with your results.
12.2: If you find you are unhappy with the images after our shoot, please get in touch so we can discuss and find an appropriate resolution.
